Estos términos regulan el uso del sitio web de Nexus Center IA LLC (Delaware, USA) y de los servicios ofrecidos a través de él.
1. Objeto
Nexus Center IA ofrece servicios de inteligencia artificial, automatización, desarrollo de software, ciberseguridad, capacitación y servicios relacionados, para clientes empresariales (B2B).
2. Uso del sitio
- El contenido del sitio es informativo y no constituye una oferta vinculante salvo acuerdo expreso por escrito.
- No está permitido el uso del sitio para fines ilícitos, ni intentar vulnerar su seguridad o disponibilidad.
3. Diagnóstico de IA
El diagnóstico digital generado automáticamente es una estimación preliminar orientativa, sin garantía de exactitud, y no sustituye una auditoría profesional completa.
4. Propiedad intelectual
La marca, logotipos, textos y diseño del sitio son propiedad de Nexus Center IA LLC. No se permite su reproducción sin autorización.
5. Contratación de servicios
Las condiciones específicas (alcance, precio, plazos) de cada servicio se acordarán en una propuesta o contrato independiente entre las partes.
6. Limitación de responsabilidad
El sitio se ofrece "tal cual". Nexus Center IA no será responsable de daños indirectos derivados del uso del sitio o de la información orientativa publicada.
7. Comunicaciones
Al enviar el formulario aceptas que te contactemos por email o teléfono en relación con tu solicitud. Puedes solicitar el cese de comunicaciones en cualquier momento.
8. Nexus IA — Agente de WhatsApp
Estas condiciones aplican específicamente a Nexus IA, el agente de inteligencia artificial que responde mensajes de WhatsApp en nombre del cliente. Al crear una cuenta y conectar un número, el cliente acepta que:
- Servicio no oficial. Nexus IA no está afiliado, patrocinado ni respaldado por WhatsApp LLC ni Meta Platforms, Inc. La conexión se realiza mediante tecnología de terceros y su uso puede infringir los Términos de Servicio de WhatsApp, pudiendo derivar en la suspensión o bloqueo del número del cliente. Nexus Center IA no será responsable por dicha suspensión, pérdida de acceso, ni por daños directos o indirectos derivados.
- Número propio. El cliente declara ser titular o estar autorizado para usar el número que conecta, y lo usa bajo su exclusiva responsabilidad; debe emplear un número del negocio, no de terceros.
- Consentimiento de sus contactos. El cliente es el único responsable de contar con el consentimiento y la base legal para comunicarse con sus contactos finales y, cuando corresponda, de informarles que sus mensajes pueden ser atendidos por un asistente automatizado (IA).
- Uso permitido. Queda prohibido usar Nexus IA para spam, mensajería masiva no solicitada, phishing, suplantación de identidad, o contenido ilícito, engañoso o que vulnere derechos de terceros. El cliente es responsable de todo el contenido enviado a través de su número.
- Respuestas de la IA. Las respuestas se generan automáticamente y pueden contener errores; el cliente es responsable de configurar y supervisar el agente, y puede tomar el control humano de las conversaciones en cualquier momento.
- Auditoría y suspensión. Nexus Center IA podrá auditar el uso del servicio y suspenderlo o cancelarlo de inmediato ante indicios de abuso, uso ilícito o riesgo para la plataforma o terceros, sin derecho a reembolso en caso de incumplimiento de estas condiciones.
- Disponibilidad y límite de responsabilidad. El servicio se ofrece "tal cual" y "según disponibilidad", sin garantía de funcionamiento ininterrumpido. La responsabilidad total de Nexus Center IA frente al cliente se limita, en todo caso, al importe efectivamente pagado por éste en los últimos tres (3) meses.
- Datos. El tratamiento de los datos de los contactos finales se rige por la Política de Privacidad, en la que el cliente actúa como responsable del tratamiento y Nexus Center IA como encargado, por cuenta e instrucción del cliente.
9. Legislación aplicable
Estos términos se rigen por las leyes del Estado de Delaware (USA), sin perjuicio de los derechos imperativos del consumidor en su país de residencia.

These terms govern the use of the Nexus Center IA LLC (Delaware, USA) website and the services offered through it.
1. Purpose
Nexus Center IA provides artificial intelligence, automation, software development, cybersecurity, training and related services for business (B2B) clients.
2. Use of the site
- Site content is informational and does not constitute a binding offer unless expressly agreed in writing.
- Use of the site for unlawful purposes, or attempting to breach its security or availability, is prohibited.
3. AI diagnostic
The automatically generated digital diagnostic is a preliminary, indicative estimate, without guarantee of accuracy, and does not replace a full professional audit.
4. Intellectual property
The brand, logos, texts and site design are the property of Nexus Center IA LLC. Reproduction without authorization is not permitted.
5. Service engagement
The specific conditions (scope, price, deadlines) of each service will be agreed in a separate proposal or contract between the parties.
6. Limitation of liability
The site is provided "as is". Nexus Center IA shall not be liable for indirect damages arising from use of the site or the indicative information published.
7. Communications
By submitting the form you agree that we may contact you by email or phone regarding your request. You may request to stop communications at any time.
8. Nexus IA — WhatsApp agent
These conditions apply specifically to Nexus IA, the AI agent that answers WhatsApp messages on the client's behalf. By creating an account and connecting a number, the client agrees that:
- Unofficial service. Nexus IA is not affiliated with, sponsored or endorsed by WhatsApp LLC or Meta Platforms, Inc. The connection uses third-party technology and its use may breach WhatsApp's Terms of Service and result in the suspension or ban of the client's number. Nexus Center IA shall not be liable for such suspension, loss of access, or any direct or indirect damages.
- Own number & contact consent. The client warrants it is entitled to use the connected number, and is solely responsible for having the consent and legal basis to message its end contacts and, where applicable, to inform them that an automated (AI) assistant may handle their messages.
- Acceptable use. Using Nexus IA for spam, unsolicited bulk messaging, phishing, impersonation, or unlawful/deceptive content is prohibited. The client is responsible for all content sent through its number.
- AI replies. Replies are generated automatically and may contain errors; the client is responsible for configuring and supervising the agent and may take human control at any time.
- Audit, suspension & liability cap. Nexus Center IA may audit usage and suspend or cancel the service upon signs of abuse or risk, with no refund for breach. The service is provided "as is" and "as available"; total liability is capped at the amount actually paid by the client in the last three (3) months.
- Data. Processing of end-contact data is governed by the Privacy Policy, where the client acts as data controller and Nexus Center IA as processor on the client's instructions.
9. Governing law
These terms are governed by the laws of the State of Delaware (USA), without prejudice to mandatory consumer rights in your country of residence.
